Article 11 de la directive machine 2006/42/CE - Clause de sauvegarde

Article 11 : Clause de sauvegarde
1. Lorsqu'un État membre constate qu'une machine à laquelle la présente directive s'applique, munie du marquage «CE», accompagnée de la déclaration CE de conformité et utilisée conformément à sa destination ou dans des conditions raisonnablement prévisibles, risque de compromettre la santé ou la sécurité des personnes et, le cas échéant, des animaux domestiques ou des biens, il prend toutes les mesures utiles pour retirer cette machine du marché, interdire sa mise sur le marché et/ou sa mise en service ou restreindre sa libre circulation.
2. L'État membre informe immédiatement la Commission et les autres États membres d'une telle mesure et indique les raisons de sa décision, en précisant en particulier si la non-conformité résulte :
a) du non-respect des exigences essentielles visées à l'article 5, paragraphe 1, point a);
b) de l'application incorrecte des normes harmonisées visées à l'article 7, paragraphe 2;
c) d'une lacune des normes harmonisées visées à l'article 7, paragraphe 2, elles-mêmes.
3. La Commission entre en consultation avec les parties concernées dans les meilleurs délais.
À l'issue de cette consultation, la Commission examine si les mesures prises par l'État membre sont ou non justifiées et communique sa décision à l'État membre qui a pris lesdites mesures, aux autres États membres, ainsi qu'au fabricant ou à son mandataire.
Commentaire :
Il s’agit d’une mesure d’ordre "nationale", dans laquelle un Etat prend des mesures pour interdire la mise sur le marché ou l’utilisation d’une machine ou pour la retirer.
